In workplace investigations, witnesses play an important role in helping establish what occurred. But what happens when a witness refuses to participate?
This can happen for many reasons. A witness may feel uncomfortable, fear workplace consequences, not want to become involved, or believe the matter has nothing to do with them.
A refusal to participate does not automatically stop an investigation.
The investigator should first consider whether the witness is genuinely necessary. Sometimes the same information can be obtained from documents, emails, CCTV, access logs, rosters, or other witnesses.
Where the witness is important, the organisation may need to explain that participation is a reasonable workplace direction, particularly if the matter involves misconduct, safety, bullying, fraud, or serious workplace concerns.
However, the process must still be handled carefully. A witness should not be threatened, pressured, or coached. They should be told the purpose of the interview, the importance of confidentiality, and how their information may be used.
If a witness continues to refuse, the investigator should record that refusal and continue assessing the available evidence.
A strong investigation does not rely on assumptions. It records what evidence was available, what evidence could not be obtained, and how that affected the findings.
