Workplace Investigations
What is a Workplace Investigation?
A workplace investigation is an independent, impartial investigation with procedural fairness, without any bias to locate evidence and making findings of fact of allegations in a workplace.
Types of workplace investigations could include:
Bullying
Any unreasonable repeated behaviour towards a worker or a group of workers which creates a risk to health and safety. This could include allegations of unreasonable criticism of a worker or an exclusion from workplace discussions or events. Even belittling someone’s work may be bullying.
Discrimination
It is illegal to discriminate and the workplace is no different. If a person is treated less favourably based on their gender, race, religion, age, sexual orientation or disability could be an unlawful ground of discrimination
Sexual Harassment
Any unwanted or unwelcome behaviour of a sexual nature causing someone to feel humiliated, intimidated or offended is a form of sexual harassment.
Workplace Safety
If an employee has a serious accident or near miss or an employee suffers an injury due to one of these violations, would constitute a workplace safety investigation.
Criminal Matters
Any matters committed in the workplace either by the employee or employer could be a matter for a workplace investigation. Matters may include theft, fraud, embezzlement and physical violence.
Company policy violations
Matters in the workplace that breach company policy violations repeatedly and/or of a serious offence, constitute a workplace investigation
